Terms of Service

1. Introduction

Welcome to Revouch ("we," "our," or "us"). By accessing or using our website, software, API, and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. The Service

Revouch is an AI-powered platform that converts text-based reviews and visual assets into video content for marketing purposes.

3. Credits, Payments, and Rollover Policy

The Service operates on a Credit System. One (1) Credit is required to generate one (1) video.

3.1. Purchases & The "Pilot"

• The $5 Pilot: The Pilot purchase is a non-refundable, one-time purchase of credits.
• Credit Packs: Credits purchased as "Top-Ups" or "Packs" (non-subscription) do not expire.
• No Refunds: All purchases are final. We do not offer refunds for used credits or credits that have been applied to your account.

3.2. Subscriptions & Rollover Policy

• Active Subscriptions: If you subscribe to a monthly plan, unused credits roll over to the next month, provided your subscription remains active.
• Cancellation: If you cancel your subscription, you forfeit all accumulated rollover credits at the end of your current billing cycle. You must use your credits before your subscription terminates.
• Rollover Cap: To prevent abuse, you may accumulate a maximum of three times (3x) your monthly allowance in rollover credits.

3.3. Credit Consumption

A credit is considered "consumed" the moment you click "Generate" or "Render."

• User Error: We do not refund credits if you disapprove of the creative output, make a typo in the script, or select the wrong voice. You are provided with a Blueprint/Drafting tool to prevent these errors before spending a credit.
• System Failure: If a technical error on our end causes a generation to fail (e.g., server timeout), the credit will be automatically refunded to your account balance.

4. User Content & Intellectual Property

4.1. Your Assets

You retain ownership of the reviews, images, and videos you upload ("User Content"). You warrant that you own or have the necessary licenses to use all User Content you upload.

Indemnification: You agree to indemnify and hold Revouch harmless from any claims resulting from your use of copyrighted music, trademarked images, or reviews that you do not have permission to use.

4.2. Output Ownership

Upon successful payment (use of a credit), you own the commercial rights to the final video file generated by Revouch. You may use it for advertising on TikTok, Meta, YouTube, and other platforms without attribution.

4.3. Platform License

By using the Service, you grant Revouch a worldwide, non-exclusive, royalty-free license to process, host, and modify your User Content solely for the purpose of generating your videos.

5. Acceptable Use Policy

You agree not to use the Service to generate content that includes:

• Hate speech, harassment, or violence.
• Deepfakes intended to deceive or impersonate public figures.
• Pornographic or sexually explicit material.
• Illegal acts or promotion of illegal goods.

Violation of this policy will result in immediate account termination without refund.

6. Third-Party Integrations

Our Service integrates with third-party platforms such as Yotpo and Judge.me.

• We are not responsible for the uptime, data accuracy, or API policies of these third parties.
• If a third-party platform revokes your API access, Revouch is not liable for your inability to import reviews. You can still use the "Manual Paste" feature.

7. Limitation of Liability

To the maximum extent permitted by law, Revouch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data.

Liability Cap: In no event shall Revouch's total liability to you exceed the amount you paid to Revouch in the twelve (12) months preceding the claim.

8. "As Is" Warranty

The Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. We do not guarantee that the Service will be uninterrupted or error-free.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Tarrant County, Texas.
